Welcome to Theresa's Sari-Sari Store. In these Terms and Conditions (“Terms”), “we,” “us” and “our” refer to Theresa's Sari-Sari Store. We operate this website and offer kitchen and household products, together with related content and features (the “Services”). Our online store is powered by Shopify, which provides the platform supporting the Services.

We offer kitchen tools, baking accessories, storage and other household items. We aim to describe products and display their colors, materials, dimensions and weights as accurately as possible, but colors may look different on different screens and measurements may vary slightly. Order Acceptance

When you place an order, you make an offer to purchase the products. An order confirmation acknowledges receipt of your order; it does not guarantee acceptance. We may decline or cancel an order for reasons such as an item being unavailable, an error in product information or pricing, suspected fraud, or an inability to process payment or deliver to the address. If we cancel an order after payment has been collected, we will refund the amount paid for the canceled items. We will contact you using the information provided where appropriate.

Pricing and Payment

Prices are shown in U.S. dollars unless otherwise stated. The checkout displays the order total, including any applicable taxes, before you submit your order. U.S. shipping is free under our current Shipping Policy. Payment methods and card acceptance depend on the options enabled and shown at checkout. Shipping and Delivery

We ship within the United States only. Orders generally require 1–3 processing business days and an estimated 3–5 business days in transit after dispatch. Delivery estimates can vary. See our Shipping Policy for the order cutoff time, shipping details, tracking and cancellations.

Returns, Exchanges and Refunds

Eligible returns and exchange requests must be initiated within 30 days after delivery, subject to the conditions and procedures in our Refunds & Returns Policy. That policy explains item eligibility, return shipping costs, the return address and refund processing.

Intellectual Property

The Services and their content, including text, design, graphics and other materials, are owned by us or used with permission from their respective owners and are protected by applicable intellectual property laws. You may use the Services for personal, noncommercial shopping. TO THE FULLEST EXTENT PERMITTED BY LAW, THERESA'S SARI-SARI STORE AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, SERVICE PROVIDERS AND LICENSORS, INCLUDING SHOPIFY AND ITS AFFILIATES, WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICES OR PRODUCTS, WHETHER BASED ON CONTRACT, TORT OR ANOTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY OR REMEDIES THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

Termination

We may suspend or terminate access to all or part of the Services where appropriate, including for a breach of these Terms, subject to applicable law. You remain responsible for amounts properly due before termination. Termination does not affect rights or obligations that by their nature should continue, including provisions concerning intellectual property, disclaimers, limitation of liability, indemnification, governing law and privacy, or any rights that cannot legally be waived.

Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Theresa's Sari-Sari Store, Shopify and their respective affiliates, officers, employees, agents, contractors, licensors and service providers from third-party claims, liabilities and reasonable costs, including reasonable attorneys' fees, arising from your breach of these Terms, your violation of law or a third party's rights, or your use of the Services. We will notify you of a claim for which indemnification is sought. We may manage the defense and settlement, and you agree to cooperate reasonably. We will not agree to a settlement imposing a non-monetary obligation on you without your consent, which will not be unreasonably withheld.
